SnapTrade Affiliate Program Participation Terms

Please note that the original version of the SnapTrade Affiliate Program Participation Terms is in German. In the event of any discrepancies or conflicts between the German version and its translation, the German version (Teilnahmebedingungen für das SnapTrade Affiliate) shall prevail.

These Participation Terms constitute an agreement between you and SnapSoft, outlining the terms and conditions for the SnapTrade Sharing-pays-off Affiliate Program. By completing the registration form, you consent to SnapSoft’s participation terms and privacy policy.

Your involvement in the affiliate program is contingent upon accepting these terms, including all related conditions, notices, and obligations. This agreement details your responsibilities as an affiliate partner and our commitments to you. Please review these terms carefully; should you disagree, participation in the program is not permitted.

The last update to these terms was on March 15, 2024, and they become effective upon your acceptance.

Eligibility to participate in the Affiliate Partner Program

To participate in the partner program, you must email us to affiliate@snapsoft.de. We will send you a registration form, which you should fill out and submit. Participation is not guaranteed; SnapSoft retains the right to accept or decline applications at its discretion. Participants must be at least 18 years old and legally capable. You must also be able to issue invoices under your or your company’s name. Small business owners as defined by § 19 of the German Value Added Tax Act (Umsatzsteuergesetz – USTG) are excluded from participation.

Referrals / new customer recommendations

You receive a commission for each qualified tester. “Qualified testers” are customers who have been recommended by you to SnapSoft and:

• have registered with SnapTrade with their own customer account,
• have used your unique affiliate referral code,
• have made a successful booking of a SnapTrade product and
• make their monthly payment.

Affiliates sharing personal or business details with the referred, including surnames, email addresses, IP addresses, website or payment details, are deemed “self-referrals,” disqualifying them from commission or other rewards. SnapSoft determines the validity of referrals.

Commissions

Commissions amount to twenty percent (20%) of the monthly net sales from referred customers to SnapSoft for the first twenty (20) months post-subscription. Commissions, plus applicable VAT, are payable after the new customer’s first payment, directly to your bank account.

Payments are made in euros via bank transfer. You’re responsible for any fees associated with payment receipt, including conversion, transaction, withdrawal, and deposit fees.

Marketing responsibilities

You will bear your own costs and expenses in connection with the marketing and promotion of SnapTrade and/or the Affiliate Program with SnapSoft. SnapSoft is under no obligation to reimburse or credit you for any marketing costs.

You may not engage in any of the following marketing activities and you represent and warrant that your marketing activities will not violate any of these restrictions:

• Affiliate Partners may not make false, misleading or disparaging statements regarding the Affiliate Program, SnapSoft/SnapTrade, its employees, its customers, its Services (as defined in SnapSoft’s Terms and Conditions) or its Affiliates.
• Affiliate Partners may not use websites with the following content: content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, racist or otherwise objectionable under the relevant statutory provisions or that could harm minors in any way, in particular content that is pornographic, glorifies violence or is otherwise harmful to minors.
• Affiliate Partners may not create websites or advertisements that copy, imitate or resemble the look and feel of SnapSoft Services. Affiliate Partners may not copy and display SnapSoft’s website or any portion thereof, including but not limited to SnapSoft’s trademarks, i. e. SnapTrade, or other intellectual property, on their own website or subdomain or use it in any way without SnapSoft’s prior express written consent.
• Affiliate Partners may not offer rebates, coupons, discounts or other incentives – other than the referral codes that SnapSoft generates for the Affiliate – as part of their marketing activities for the Affiliate Program.
• Affiliate Partners may not use traffic generated by pay-per-click, pay-per-read, banner exchange, click exchange, cost-per-view advertising, pop-up/under, spam, purchased traffic or similar methods without SnapSoft’s prior written consent.
• Affiliate Partners may not bid on or use the SnapSoft/SnapTrade brand or misspelled keywords for the purpose of pay-per-click in Internet search engines without SnapSoft’s prior written consent.
• Affiliate Partners may not use the SnapSoft/SnapTrade brand or misspelled keywords in their domain names.
• Affiliate Partners may not redirect the customer to an intermediary website via links or web pages that require the tester to enter into a contract or other obligation to a third party prior to redirection to SnapSoft.
• Affiliate Partners may not engage in domain redirects (i.e., purchase a domain and set it up to redirect directly to the SnapSoft website via a link)
• Affiliate partners must not use marketing activities that attract fraudulent customers.
• Affiliate Partners may not engage in marketing activities that could damage the reputation or credibility of SnapSoft/SnapTrade, including the use of low-quality marketing materials or advertising on websites that promote violence, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or illegal activities, or that infringe the intellectual property or other rights of third parties.
• Affiliate Partners may not engage in marketing or promotional activities that violate any applicable laws, rules or regulations.
• Affiliate Partners may not engage in telephone, fax, broadcast, telemarketing, SMS marketing or other offline marketing methods relating to SnapSoft or the SnapTrade Services without the express written consent of the contacted prospect.
• Affiliates may not use malware or spyware to market or promote SnapSoft/SnapTrade services.

Termination

SnapSoft may, in its sole discretion, terminate your participation in the Affiliate Program at any time, with or without cause, and without warning or notice. SnapSoft reserves the right to terminate your participation in the Affiliate Program and not pay out any accrued commission if you have violated SnapSoft’s terms and conditions of participation set forth above or have engaged in conduct that is unlawful, defamatory or immoral.

At SnapSoft’s sole discretion, Partner Accounts that generate a large number of fraudulent accounts or that are associated with false or misleading advertising or suspected fraudulent activity will be disabled.

You can terminate your participation in the partner program at any time. For accounting purposes, SnapSoft’s systems will retain your account and personal information.

All rights granted to you expire immediately upon termination. The outstanding Affiliate Partner commission will be paid to you in a final transfer, provided that you have not violated any of the above points.

Relationship between you and SnapSoft

Neither these Terms nor your participation in the Affiliate Partner Program shall create an employment relationship, contract, agency, partnership or joint venture between you and SnapSoft.

Motifications to Participation Terms

SnapSoft reserves the right to modify these terms for valid reasons, such as technical advancements or legal changes, with notice provided to affiliates.
